These Terms of Service ("Terms") govern your use of mannafield.com (the "Website") and any purchase you make from Mannafield ("Mannafield", "we", "us", "our"). Abiding Light is the name of our cross night light. You may see either name on our Website, at checkout and in our emails. By using the Website or placing an order, you agree to these Terms and to the policies they include: our Refund Policy, Shipping Policy and Privacy Policy. If you don't agree, please don't use the Website or place an order.

Please read section 16 carefully. It requires most disputes to be resolved through individual arbitration instead of in court, and waives class actions, unless you opt out within 30 days of your first purchase.

1. Eligibility and your information

  • You must be at least the age of majority where you live and able to enter into a binding contract to place an order.
  • You agree to give us correct, current and complete information, including your name, email address, payment details and shipping address, and to keep it up to date. You're responsible for the accuracy of the information you provide. Orders shipped to the address you entered follow section 8 of our Shipping Policy.
  • If you create an account, you're responsible for keeping your login details secure and for all activity under your account.

2. Using our products safely

  • The Abiding Light cross night light is a decorative night light for use indoors. Use it only as described in its instructions.
  • It's an electrical product. Use only a power source in good condition, as described in its instructions.
  • Keep it away from water and heat. If the light, its cable or its switch is damaged, unplug it and stop using it.
  • It isn't a toy. If you use it in a child's room, an adult should set it up and supervise its use, and keep the cord where children can't reach it.
  • We're not responsible for damage, injury or loss caused by misuse, modification of the product, or not following the instructions.

3. An item of faith, not professional care

Our light is a decorative item of faith. It isn't a medical device, and it isn't medical, mental health or grief counseling. The words on our Website, packaging, emails and social media are general information and encouragement. They don't replace care from a doctor, a licensed counselor or your pastor.

Every person and every home is different. Customer stories and reviews describe their own experience and aren't a promise that yours will be the same. If you don't love your light, our 30-Day Money-Back Guarantee, described in our Refund Policy, is your remedy. More details are in our Disclaimer.

4. Orders

  • When you place an order, you make an offer to buy. Your order confirmation email confirms that we received your order; it doesn't mean we've accepted it. Your order is accepted when we ship it.
  • We may refuse, limit or cancel any order, including when a product is unavailable, there's an error in the price or product information, we suspect fraud or unauthorized payment, an order appears to be placed for resale, or an order breaks these Terms. If we cancel an order after you've paid, we refund the full amount to your original payment method.
  • We may limit quantities per person, household, address or payment method.
  • Our products are sold for personal use and gifting, not for resale.
  • We sell and ship to addresses in the United States only.
  • You can change or cancel an order within 2 hours of placing it, as described in section 6 of our Refund Policy.

5. Prices, promotions and payment

  • Prices are shown in US dollars.
  • You pay the price shown when you place your order. We may change prices, products and promotions at any time without notice. Changes don't affect orders we've already accepted.
  • Bundle discounts are applied automatically in your cart. Discounts don't combine with each other, have no cash value and can't be applied to past orders.
  • Limited-time offers, discounts, free shipping and free gifts may change or end at any time, and may be limited to available stock. Free gifts have no cash value, can't be exchanged for cash, and may be replaced with an item of similar value.
  • Sales tax is added where required and shown at checkout.
  • By paying, you confirm that you're authorized to use the payment method, that your payment details are correct, and that the charges will be honored by your card issuer.
  • Despite our efforts, the Website may occasionally contain errors in prices, descriptions, availability or delivery times. We may correct them at any time, including after you've placed an order, and cancel affected orders with a full refund.

6. Shipping and delivery

  • Delivery times are estimates, not guarantees. Our Shipping Policy explains processing, delivery times, costs, tracking and our Christmas delivery date.
  • Title and risk of loss pass to you when we hand your order to the carrier. If your order has Shipping Protection and the package is lost, stolen or damaged in transit, we send a new one for free, as described in our Shipping and Refund Policies. Without it, we help you file a claim with the carrier.
  • You agree that the carrier's delivery confirmation, including tracking that shows your package as delivered, is sufficient proof of delivery, even without a signature.
  • You're responsible for entering a correct and complete shipping address. Packages delivered to, refused at, or returned from the address you entered follow section 8 of our Shipping Policy.

7. Refunds and the 30-Day Money-Back Guarantee

Refunds, replacements and the 30-Day Money-Back Guarantee are governed only by our Refund Policy. The guarantee is for your first order, applies once per household and covers up to 4 lights. Digital products are final sale and aren't refundable, as described in our Refund Policy. We may refuse refunds, replacements or future orders if we see abuse, such as repeated claims, claims across several accounts or addresses for the same household, or false information in a claim.

8. Payment disputes and chargebacks

  • If there's a problem with your order, or you don't recognize a charge from Mannafield, please write to us first at support@mannafield.com. Most issues are solved quickly, and you agree to give us a chance to resolve yours before you dispute a charge with your bank or card issuer.
  • If you dispute a charge for an order that was delivered or handled under our policies, we'll respond with evidence, including your order details, tracking and delivery confirmation, your acceptance of these Terms at checkout, and our messages with you.
  • If a dispute is decided in our favor, the charge remains due. If we refund or replace an order and you also receive money back through a dispute for the same order, you agree to repay the duplicate amount.
  • We may refuse future orders from customers who file disputes that aren't justified.

9. Reviews, photos and other content you send us

  • When you send us or post reviews, photos, videos, comments or ideas ("Submissions"), you give Mannafield a non-exclusive, worldwide, royalty-free, perpetual, irrevocable and sublicensable right to use, copy, edit for length and format, publish and display them in any media, including in advertising, together with your first name and last initial.
  • You confirm that your Submissions are honest and based on your own experience, that you own the rights to them, and that you've disclosed any free product, discount or other incentive you received for them.
  • We may remove Submissions that are unlawful, offensive, off-topic, fake, or that infringe someone else's rights. We don't remove reviews just because they're negative, and we don't edit them in a way that changes their meaning.

10. Intellectual property

The Website and its content, including the Abiding Light and Mannafield names and logos, text, product names, photos, videos, graphics, reviews and page design, belong to us or our licensors and are protected by copyright, trademark and other laws. You may use the Website for your personal, non-commercial use only. You may not copy, reproduce, modify, distribute or republish any of it without our written permission, including using our product images, videos, reviews or page content on other websites, stores or ads.

Our eBook, 30 Nights Closer to God, is for your personal use. You may print it and share it with family and friends. Please don't sell it, post it online or share it publicly.

11. Acceptable use

You agree not to:

  • use the Website for any unlawful or fraudulent purpose, or break any law or these Terms;
  • place orders with false information, someone else's identity or a payment method you're not authorized to use;
  • scrape, crawl or copy the Website, or use bots or automated tools on it without our written permission;
  • interfere with the Website's security or operation, or upload viruses or malicious code;
  • harass, abuse or threaten our team or other customers, or post false, misleading or defamatory content;
  • resell our products or use the Website for commercial purposes without our written permission.

12. Third-party services

Our store runs on Shopify, and we use third-party services for things like payments, shipping and email. Their own terms and privacy policies apply to your use of them, and we're not responsible for their services or for third-party websites linked from ours. Purchases on the Website are made directly with Mannafield. Shopify is not responsible for any part of these sales, and you release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases from Mannafield.

13. Disclaimer of warranties

Except for the promises set out in our Refund Policy (including the 30-Day Money-Back Guarantee and the free replacement of lost, damaged or defective lights), and to the fullest extent permitted by law, the Website and all products are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. Where an implied warranty can't be excluded, it's limited to 30 days from delivery or the shortest period allowed by law. We don't guarantee that the products will meet your expectations, or that the Website will be uninterrupted, secure or free of errors.

14. Limitation of liability

To the fullest extent permitted by law, Mannafield and its owners, employees, suppliers and service providers are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, data or goodwill, arising from or related to the Website, our products or these Terms, however caused and even if we were told they were possible. Our total liability for any claim related to an order is limited to the amount you paid for that order. The remedies in our Refund Policy are your sole and exclusive remedies for products that don't meet your expectations. Some states don't allow these limits, so some of them may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless Mannafield, its owners, employees, suppliers and service providers from any claims, losses, damages and costs, including reasonable attorneys' fees, arising from your breach of these Terms, your misuse of our products or the Website, or your violation of any law or anyone else's rights.

16. Disputes, arbitration and class action waiver

  • Talk to us first. Before starting any claim, email support@mannafield.com with your name, order number, a description of the problem and what you're asking for. We'll try to resolve it informally within 60 days.
  • Binding individual arbitration. If we can't resolve it, any dispute arising from or related to these Terms, the Website, our products or your orders will be resolved by binding arbitration on an individual basis, administered by the American Arbitration Association under its Consumer Arbitration Rules and governed by the Federal Arbitration Act. The arbitration may be held by video, phone or written submissions, or in the county where you live. The arbitrator may award the same individual relief a court could.
  • Exceptions. Either of us may bring an individual claim in small claims court. We may also go to court to protect our intellectual property.
  • Class action waiver. You and Mannafield each agree to bring claims only individually, and not as a plaintiff or class member in any class, collective or representative action. You and Mannafield each waive the right to a jury trial. If this class action waiver is found unenforceable for a claim, that claim will be decided in court, not in arbitration.
  • Opting out. You can opt out of this section by emailing support@mannafield.com within 30 days of your first purchase, with your name, order number and a statement that you opt out of arbitration.
  • Governing law. These Terms are governed by the Federal Arbitration Act, US federal law and the laws of the State of California, without regard to conflict of law rules. Any claim that isn't arbitrated will be heard in the state or federal courts located in Los Angeles County, California.

17. Emails and text messages

  • You agree that we may communicate with you electronically, and that notices, agreements and other messages we send you electronically count as being in writing.
  • We send order and shipping updates by email. We send marketing emails only if you've agreed to receive them, and you can unsubscribe anytime using the link in any email.
  • We don't send marketing text messages.

18. Suspension and termination

We may suspend or end your access to the Website or refuse orders if you break these Terms, provide false information, or act in a way that could harm Mannafield or other customers. You remain responsible for all amounts due until then. Sections that by their nature should continue, including sections 9 to 16, survive termination.

19. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Changes apply to orders placed after they're posted; each order is governed by the Terms in effect when it was placed.

20. General

  • If any part of these Terms is found unenforceable, it will be enforced as far as the law allows, and the rest of the Terms stay in effect.
  • If we don't enforce a right or provision, that doesn't mean we waive it.
  • These Terms and the policies they include are the entire agreement between you and Mannafield about the Website and your purchases.
  • You may not transfer your rights under these Terms. We may transfer ours, for example if our business is sold or reorganized.
  • Headings are for convenience only and don't affect how these Terms are read.
